Using a Quit Claim Deed to Transfer Property Rights to Family Members

One of the easiest and most common ways to transfer property rights to another party in Florida is through the use of a quit claim deed. This type of deed conveys the interest you have in a property without providing any warranties or guarantees about the interest you are conveying.

Uses for a Quit Claim Deed

Quit claim deeds are typically used between people who have a close relationship — i.e., family members, former spouses and close friends. In Florida, you can use a quit claim deed to:

  • Clarify how property is owned among property owners;
  • Transfer property to or from a living trust;
  • Transfer property to a spouse in a divorce;
  • Clarify property ownership among heirs;
  • Transfer one property owner’s rights to another property owner;
  • Transfer all or a part of your property ownership to another party;
  • Make changes in the way that owners hold title to the property; and
  • Correct any mistakes in previously recorded deeds.

Creating a Quit Claim Deed

While there are several sources for quit claim deed forms on the Internet or even at office supply stores, you should consider consulting with a Florida real estate attorney to execute your quit claim deed. This is because once you file it, a quit claim deed is irrevocable, and cannot be changed or undone without filing another deed.

Quit claim deeds may not be effective if they are not prepared properly or executed properly. A Florida real estate attorney can ensure that the legal formalities required for deeds are met, and that you thoroughly understand what the conveyance process entails. Once the deed is properly executed, it must then be recorded in the public records of whatever county the property is located in. A real estate attorney can also handle that process to ensure that the deed is properly recorded.
