The O-1B Visa for Recording Artists
The O-1 visa is available to foreign nationals who possess extraordinary ability in the arts, sciences, business, education or athletics and have been recognized in their native countries or internationally for their achievements.
Because the O-1 visa has no maximum annual limit and O-1 petitions are processed fairly quickly by the U.S. Citizenship & Immigration Service (USCIS), they are attractive to foreign recording artists wishing to live and work in the U.S.
O-1B Visa for Recording Artists
The O-1B visa is for foreign nationals with extraordinary ability in the arts or extraordinary achievement in film or television. This classification includes the performing arts, and foreign recording artists typically apply for an O-1B to come to the U.S. to work.
To qualify for an O-1B visa, you must provide evidence that you have received national or international recognition in your area of expertise and will be coming to the U.S. to work in that area. This evidence can include at least three of the following:
- Recipient of a national or international award or prize in your field of expertise;
- Membership in associations relating to your field of expertise where outstanding achievement is a prerequisite for membership;
- Published material in professional or major trade publications or media about your work;
- Original scholarly, scientific or business contributions of major significance in the subject field of expertise;
- Authorship of scholarly works in the field of expertise;
- A high salary or other remuneration for services;
- Service as a judge, individually or on a panel, of the works of others in the field of expertise; or
- Works in a critical or essential capacity for entities with a distinguished worldwide reputation.
Recipients of an O-1B visa can stay in the U.S. for up to three years and then apply for an extension. There is no maximum limit of extensions that can be granted.
