Where Executors Can Turn for Help with Florida Probate

If you have served as an executor (also known as the personal representative) of an estate, then you probably already know that the Florida probate process can be confusing, lengthy and expensive. If you have been named executor of an estate and have no prior experience, it may be a little overwhelming to deal with the maze of deadlines, notifications and potential liabilities.

Probate is a complex legal process where the will is validated, heirs are determined, assets are inventoried and appraised, debts are paid and assets are ultimately distributed – all under the supervision of a judge.

Executors navigating the court system may decide to obtain assistance from an attorney to help them through the process. In addition to the complexity of the process, there are additional reasons why executors would want to consult with a Florida probate attorney, including:

  • When there are numerous beneficiaries receiving bequests that vary in value;
  • When the estate is large with a variety of different types of assets;
  • When the executor of a Florida estate lives in another state;
  • If the estate may be subject to creditor claims;
  • If the decedent’s will cannot be found, or has not been updated to include a new spouse, child, or other life changing event; or
  • If it is likely that the will could be challenged or contested.

As executor, you are considered the responsible party during the Florida probate process and may be held accountable by the beneficiaries. If the estate is large or complex, an executor can be tied up for years with depositions and court appearances.

In addition to navigating the process, you are also responsible for a number of legal and financial tasks that you may not feel qualified to handle.

Florida law also specifically requires that the executor retain a Florida attorney for most of type of probate estates. While you may think that any attorney will do, you really need an experienced lawyer that dedicates a great deal of their time to helping clients with probate matters.
